TERMS OF SERVICE
These Terms of Service govern all access to and use of the products and services offered by Psalms and Promises. By purchasing or using any product or service provided by Psalms and Promises, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. If you do not agree to these Terms of Service, you must discontinue all use of the site and its services.
1. Scope of Services
Psalms and Promises provides customized digital products, including personalized Christian dedication songs and other faith centered digital content. All existing offerings are delivered electronically.
Psalms and Promises may expand its catalog in the future or introduce new categories such as physical products or services at its discretion. Any future offerings will be governed by these Terms of Service unless supplemented or replaced by updated terms.
2. Eligibility
Use of the site and placement of an order requires that the client be at least eighteen years of age or the legal age of majority in the client’s jurisdiction. By using the site, the client affirms compliance with all applicable eligibility requirements.
Psalms and Promises does not knowingly collect personal information from children under the age of thirteen or any minor without verifiable parental consent. If a minor accesses or uses the services, it must be under the supervision of a parent or legal guardian, and any submitted information must be provided with their knowledge and consent. If we become aware that personal information has been submitted by a minor without appropriate consent, we reserve the right to delete such information from our records and may refuse service.
3. Client Submissions and Custom Orders
Personalized products require the client to submit specific information, including names, dedications, and related content. The client is solely responsible for verifying the accuracy, spelling, and completeness of all submitted materials.
By submitting content, the client grants Psalms and Promises all rights necessary to create the commissioned work. Psalms and Promises may decline any submission that is unlawful, inappropriate, or inconsistent with its mission and values.
4. Production and Delivery
All production and delivery timeframes are estimates provided solely for convenience and do not constitute binding guarantees. Timelines may vary based on operational, creative, or technical factors. Variations or delays do not entitle the client to cancellation or refund unless required by law.
All digital products are delivered electronically through the email address supplied by the client or through any other approved digital delivery method. A product is deemed delivered once transmission has occurred.
5. Intellectual Property
All recordings, compositions, lyrics, voiceovers, arrangements, designs, and all other creative materials produced by Psalms and Promises are the exclusive intellectual property of Psalms and Promises.
Clients receive a limited, nonexclusive, royalty free license permitting personal use of the delivered product. Clients may not reproduce, distribute, resell, publicly broadcast, publish, or exploit the product for any commercial purpose without prior written consent from Psalms and Promises.
6. Prohibited Conduct
Clients must not interfere with the operation of the website or any systems owned or operated by Psalms and Promises. Clients must not attempt to circumvent security measures or use the services for any unlawful purpose or in any manner that harms or disrupts the business.
7. Fees and Payment
All fees must be paid in full at the time of purchase. Pricing is subject to change at any time, but revisions do not affect previously accepted orders.
All payments are processed through third party payment processors. Psalms and Promises does not store or retain any payment card information.
8. Refund Policy
All customized digital products are final and nonrefundable once production has begun. A refund may be granted only if Psalms and Promises has not commenced work on the order at the time the request is made, or if a refund is required by applicable law.
If an error is solely attributable to Psalms and Promises, the company may choose to correct the error or produce a revised version of the product.
9. Disclaimer of Warranties
All products and services are provided on an as is and as available basis. Psalms and Promises makes no warranties of any kind, whether express or implied, including any warranty of fitness for a particular purpose or any warranty of expected emotional or spiritual outcome.
10. Limitation of Liability
To the fullest extent permitted by law, Psalms and Promises shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use or inability to use any product or service. The total liability of Psalms and Promises for any claim shall not exceed the amount paid for the specific order giving rise to the claim.
11. Indemnification
Clients agree to indemnify, defend, and hold harmless Psalms and Promises, including its owners, employees, contractors, and affiliates, from any claims, losses, liabilities, damages, or expenses arising out of client submitted content or misuse of any product or service.
12. Modifications
Psalms and Promises may revise these Terms of Service at any time. Continued use of the site after the posting of any modification constitutes acceptance of the updated terms.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which Psalms and Promises operates. All disputes shall be resolved exclusively in the courts of that jurisdiction.
